1. Introduction

Welcome to LaunchPal.io ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the LaunchPal.io platform, including our website, applications, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

LaunchPal.io is a B2B SaaS platform that helps CPG/FMCG brands connect with retail buyers through AI-powered lead generation and personalized email outreach campaigns.

2. Account Registration

To use our Service, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activities.

4. Acceptable Use Policy

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Send spam, unsolicited bulk emails, or deceptive messages
• Violate any applicable anti-spam laws (CAN-SPAM, GDPR, etc.)
• Impersonate any person or entity, or falsely claim affiliation
• Harvest or collect email addresses without consent
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any systems
• Upload malicious code, viruses, or harmful content
• Resell or redistribute the Service without authorization

5. Subscription & Payment

LaunchPal.io offers the following subscription tiers:

• Free Tier: Trial campaigns only, limited to 5 leads per campaign, no email sending capabilities
• Launch Tier ($300/month): 500 leads per month, full email sending capabilities, priority support

Lead quotas do not roll over between billing periods. Subscriptions are billed monthly and can be cancelled at any time. Refunds are handled on a case-by-case basis.

6. Intellectual Property

The Service, including all content, features, and functionality, is owned by LaunchPal.io and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you submit through the Service, but grant us a license to use, store, and process that content to provide the Service.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE ANY SPECIFIC RESULTS FROM USING THE SERVICE, INCLUDING RESPONSE RATES OR BUSINESS OUTCOMES.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAUNCHPAL.IO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of New Zealand.
